I am still in process of applying for asylum/I have only received toleration [Duldung]. Can my child still go to school?

Yes, even if you do not have guaranteed residency status in Germany, your child has the right and obligation to go to school. The time from which your child is obliged to attend school depends on the state in which you live. Generally there are special preparatory classes to prepare children who do not speak German very well for lessons in German.

For children with a temporary residence permit (Aufenthaltsgestattung) or a toleration (Duldung), children must attend school after living in Germany for six months.

For children with a temporary residence permit (Aufenthaltsgestattung) or a toleration (Duldung), children must attend school after living in Germany for three months.

For children with a temporary residence permit (Aufenthaltsgestattung) or a toleration (Duldung), children must attend school once they are no longer required to live in an intake facility, that is, after living in Germany for six months at the most.
